Terms & Conditions | West Rock Wake Park – Rockford, IL

West Rock Wake Park LLC d/b/a West Rock Wake Park ("West Rock," "we," "us," or "our") provides outdoor recreation, wakeboarding, cable park activities, lessons, camps, clinics, events, rentals, merchandise, and related hospitality services in Rockford, Illinois. These Terms & Conditions ("Terms") govern your access to and use of the West Rock Wake Park website, online booking system, passes, memberships, lessons, camps, clinics, rentals, events, merchandise, wakeboard equipment, apparel, related gear, and on-site services.

By using our website, making a purchase, booking a session, signing a waiver, entering the property, participating in any activity, or otherwise using West Rock Wake Park services, you agree to these Terms.

1. About West Rock Wake Park

West Rock provides outdoor recreation, wakeboarding, cable park activities, lessons, camps, clinics, events, rentals, merchandise, and related hospitality services in Rockford, Illinois.

These Terms apply to all guests, riders, spectators, parents, legal guardians, members, passholders, event attendees, website users, and customers.

2. Eligibility and Minors

Participants must meet all posted age, height, weight, skill, safety, and equipment requirements for each activity. West Rock staff may determine whether a participant is eligible for a particular activity, feature, obstacle, speed, rental, lesson, camp, clinic, or session format.

Minors must have a parent or legal guardian complete required waivers, consents, registrations, and payment authorizations. Parents and legal guardians are responsible for supervising minors unless the minor is enrolled in a supervised program.

3. Waivers, Safety Video, Orientation, and Emergency Assistance

Every rider needs to have one waiver signed per season. If a rider is under 18, a legal guardian must sign. Waivers should be completed before the start of a session. Guests who do not complete required waivers may be denied participation without refund.

West Rock may require guests to watch a safety video, complete a safety briefing, follow posted rules, or receive staff instruction before participating. Any safety video or orientation materials are intended to supplement, not replace, these Terms, posted rules, staff instructions, or the separate participant waiver.

In the event of an injury, illness, accident, or emergency, West Rock may contact emergency services, provide basic assistance, notify emergency contacts, or take other reasonable steps it determines appropriate under the circumstances. Guests, parents, and legal guardians are responsible for all medical, ambulance, emergency-response, or related costs.

4. Assumption of Risk

Wakeboarding, cable riding, watersports, obstacle use, dock activities, floating walkway use, rentals, lessons, coaching, camps, clinics, events, and outdoor recreation involve inherent risks, including the risk of serious injury, property damage, or death.

These risks may include, without limitation, slips, trips, falls, collisions; contact with cables, ropes, handles, carriers, towers, motors, moving mechanical equipment, rental equipment, features, docks, floating walkways, platforms, ramps, shoreline areas, stairs, gravel, grass, parking areas, wet surfaces, uneven surfaces, or other structures; start/stop movements, speed changes, falls while riding, attempted tricks or progressions, obstacle or feature use, unauthorized swimming or water entry, public lake conditions, water quality conditions, fish hooks, lures, fishing line, sharp objects, rocks, sticks, shells, mud, algae, aquatic plants, insects, wildlife, submerged or floating objects, debris, sun, heat, humidity, cold water, wind, rain, changing weather, public park activity, and conduct by third parties outside West Rock's reasonable control.

By participating, purchasing products, renting equipment, entering the property, using docks, walkways, shoreline areas, public areas, parking areas, or using West Rock services, you acknowledge and assume the risks associated with these activities and conditions. You agree to use all products, equipment, facilities, access points, docks, walkways, and public areas in accordance with manufacturer guidelines, staff instructions, posted rules, and safety standards.

Completion of these Terms does not replace West Rock's separate waiver, release of liability, assumption of risk, and indemnity agreement.

5. Park Rules and Safety Requirements

All guests must follow posted rules, staff instructions, safety briefings, signage, equipment requirements, public park rules, local ordinances, lawful instructions from public authorities, and West Rock policies. West Rock may remove or restrict any guest who behaves unsafely, ignores staff instructions, damages property, harasses others, appears impaired, violates park rules, or creates an unsafe or disruptive environment.

West Rock may require:

  • USCG-approved life jackets, approved impact vests, helmets, or other required safety gear.
  • Appropriate boards, bindings, handles, ropes, helmets, vests, and activity-specific equipment.
  • Skill-level restrictions for advanced features, obstacles, tricks, speeds, or activities.
  • Completion of beginner instruction or staff approval before certain activities.
  • Compliance with dock, cable, obstacle, equipment, weather, maintenance, public park, and designated water-area rules.

No swimming is permitted at West Rock, and guests may not enter the water except as part of authorized West Rock activities or as instructed by West Rock staff. West Rock is not a public swimming facility and does not provide lifeguard-supervised swimming.

Spectators, non-riders, children, and other guests may not enter docks, launch areas, return areas, floating walkways, cable operating areas, equipment areas, or restricted zones unless authorized by West Rock staff.

Fishing is not permitted from West Rock docks, floating walkways, launch areas, cable operating areas, or other restricted West Rock-controlled areas unless expressly authorized.

Diving, jumping, flipping, or entering the water from docks, walkways, platforms, railings, structures, shoreline areas, or unauthorized areas is prohibited unless expressly part of an authorized West Rock activity and approved by staff.

Guests are encouraged to wear appropriate footwear when walking around docks, shoreline areas, public park areas, walkways, parking areas, or other non-riding areas.

Parents and legal guardians are responsible for supervising minors in public areas, shoreline areas, dock-adjacent areas, walkways, parking areas, and non-riding areas unless the minor is actively participating in a supervised West Rock program.

Guests should promptly notify West Rock staff if they observe fish hooks, fishing line, sharp objects, debris, unsafe conditions, damaged equipment, or other hazards.

6. Swimming, Docks, Floating Walkways, Public Lake, and Fishing-Related Hazards

Swimming is not permitted at West Rock Wake Park. West Rock is a wakeboarding and cable park facility, not a public swimming area, and does not provide lifeguard-supervised swimming. Guests who choose to swim, enter the water outside of authorized participation, or use the lake in a manner not permitted by West Rock do so at their own risk. To the fullest extent permitted by law, West Rock is not responsible for injuries, incidents, property damage, or other issues arising from a guest's decision to swim or otherwise enter the water outside of authorized West Rock activities.

West Rock may provide floating walkways, docks, platforms, ramps, shoreline access points, or similar structures to help riders return to the dock or move through designated areas. These surfaces may be wet, slippery, uneven, moving, unstable, affected by weather or water conditions, or otherwise hazardous. Guests must use caution, follow staff instructions, and use these areas only as intended.

West Rock operates within or near a public park and public lake environment that may be used by members of the public, including fishermen and other lake users. West Rock does not control all public lake activity, fishing activity, discarded fishing hooks, lures, lines, sharp objects, debris, natural hazards, water quality, or other conditions in or around the public lake, shoreline, dock area, or water.

Because West Rock operates in an outdoor public park and lake environment, guests may encounter natural, public-use, or environmental conditions outside West Rock's reasonable control, including rocks, sticks, shells, mud, algae, aquatic plants, insects, wildlife, debris, submerged objects, floating objects, fishing line, hooks, lures, or other sharp objects. West Rock does not guarantee that lake water will be free from bacteria, algae, contaminants, natural conditions, or other environmental conditions.

Guests acknowledge that these conditions may exist and agree to use caution. To the fullest extent permitted by law, West Rock is not responsible for injuries or damages caused by unauthorized swimming, misuse of docks or floating walkways, public lake conditions, fishing activity, fishermen, fish hooks, lures, fishing line, sharp objects, debris, water quality, natural conditions, or third-party conduct outside West Rock's reasonable control.

Guests should promptly notify West Rock staff if they observe fish hooks, fishing line, sharp objects, debris, unsafe conditions, damaged equipment, or other hazards. Reporting a hazard does not mean West Rock created, knew of, controlled, or assumed responsibility for that condition before it was reported.

7. Bookings, Passes, Memberships, Programs, and Capacity

Bookings, passes, memberships, lessons, camps, clinics, events, rentals, private sessions, and programs are subject to availability, posted schedules, capacity limits, weather, maintenance, staffing, operational needs, and safety considerations.

Unlike ski resorts, West Rock cables have limited capacity. We aim to provide a predictable, safe, and fun environment for all skill levels. West Rock may modify hours, session formats, cable operations, features, programs, or schedules at any time.

Passes and memberships are personal and non-transferable unless expressly stated. They may be subject to blackout dates, expiration dates, program restrictions, cancellation rules, or additional terms displayed at purchase.

8. Cancellation, Refund, and No-Show Policy

The following policy applies unless a purchase page, event description, membership agreement, camp registration, private rental agreement, or written confirmation states otherwise.

Regular Bookings

  • Cancel at least 24 hours before your session for a full refund.
  • If canceling within 24 hours, you may choose between a full credit to use later or a 50% refund if you do not plan to return.
  • Late arrivals may lose ride time. No-shows may forfeit the booking, subject to West Rock discretion.

School of West Rock / Camps

  • Full refund if canceled 7 or more days before camp.
  • 50% refund if canceled within 7 days of camp, or up to 90% refund with valid medical documentation approved by West Rock.
  • After camp begins, campers withdrawing for medical reasons with a note may receive prorated credit for future use.
  • No prorated fees are provided for late arrivals or early departures.
  • West Rock reserves the right to dismiss campers for inappropriate behavior, unsafe conduct, or serious rule violations without a refund.

Weather and Maintenance Closures

  • If West Rock must close due to weather or maintenance, we will notify guests as soon as reasonably possible.
  • If storms, heavy rain, or severe weather are possible, guests should check the "hours/weather info" section of the West Rock website before leaving for the park.
  • When West Rock closes due to weather or maintenance, guests may receive credit for a future visit based on the unused portion of their session. If a guest cannot return within the same calendar year, West Rock may provide a refund for the unused portion.

9. Weather, Safety Closures, and Operational Interruptions

Outdoor recreation is affected by weather and conditions beyond West Rock's control. West Rock may delay, pause, reschedule, or close activities due to lightning, high winds, severe weather, heavy rain, poor visibility, water conditions, mechanical issues, power outages, safety concerns, staffing limitations, special events, private rentals, government orders, or emergency conditions.

Guests acknowledge that outdoor recreation may involve exposure to sun, heat, humidity, cold water, wind, rain, insects, and changing weather conditions. Guests are responsible for using sunscreen, staying hydrated, dressing appropriately, and deciding whether they are physically able to participate under current conditions.

Weather-related credits, refunds, or rescheduling options are handled according to the cancellation and weather policy above and any additional terms displayed at purchase.

10. Lessons, Coaching, Skill Progression, and Participant Choice

Lessons, coaching, staff guidance, demonstrations, and progression recommendations are intended to help participants improve their skills and make more informed decisions, but results are not guaranteed and no recommendation eliminates the inherent risks of wakeboarding, cable riding, obstacles, features, tricks, or advanced maneuvers.

West Rock coaches, instructors, and staff may suggest tricks, features, obstacles, speeds, equipment, progressions, or skill-development options that they believe may be appropriate based on the participant's apparent ability, conditions, and available information. While West Rock aims to recommend reasonable and lower-risk progression options when possible, each participant remains solely responsible for deciding whether to attempt any trick, maneuver, skill, feature, obstacle, jump, rail, ramp, advanced area, or progression.

A coaching recommendation, staff suggestion, demonstration, safety tip, encouragement, or approval to attempt a progression does not mean the activity is safe, risk-free, or appropriate for every participant. Participants should not attempt any trick, feature, obstacle, maneuver, or progression unless they personally believe they have the ability, control, judgment, and physical condition to do so safely. To the fullest extent permitted by law, West Rock is not responsible for injuries, damages, or losses arising from a participant's decision to attempt a trick, maneuver, skill, feature, obstacle, jump, rail, ramp, advanced area, or progression, including when the participant requested or received guidance from West Rock coaches, instructors, or staff.

Obstacles, features, jumps, rails, ramps, and advanced areas are optional and may be restricted based on skill level, equipment, conditions, or staff judgment. Guests should not attempt any feature, obstacle, trick, or maneuver beyond their ability or without understanding the risks involved.

11. Equipment Rentals and Damage

Rental equipment must be used only as instructed and returned in the same condition, ordinary wear excepted. Guests may be responsible for loss, theft, misuse, or damage to rental equipment, including boards, bindings, helmets, vests, handles, ropes, or other gear. West Rock may charge repair or replacement fees for damaged or unreturned equipment. Guests are responsible for notifying staff before use if equipment does not fit properly, feels unsafe, appears damaged, or is not functioning as expected.

12. Merchandise, Wakeboard Equipment, Apparel, and Gear

These merchandise terms apply to purchases of apparel, accessories, wakeboard equipment, technical gear, and related products from West Rock.

Product Availability

All products are subject to availability. West Rock reserves the right to limit quantities, discontinue items, or substitute comparable products at its discretion without prior notice.

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes, shipping, and handling fees, if any, will be added at checkout. West Rock strives for pricing accuracy but reserves the right to correct errors. If an error occurs, we may cancel or adjust an order accordingly.

Payment

Payment is due in full at the time of purchase unless otherwise stated. We accept approved forms of payment, including credit/debit cards and any other methods we make available. If you believe there is an error with a charge, booking, refund, or purchase, please contact West Rock first so we can attempt to resolve the issue directly.

Returns and Exchanges

Retail Merchandise (Apparel, Accessories, General Goods): Returns or exchanges may be accepted within 30 days of purchase with a valid receipt. Items must be unused, unworn, and in original packaging with tags attached.

Wakeboard Equipment and Technical Gear

Due to the nature of these products, all sales may be final unless the item is defective. Any approved return is subject to inspection and may incur a restocking fee of up to 15%.

Non-Returnable Items

West Rock reserves the right to deny any return or exchange that does not meet these conditions. Non-returnable items include clearance or sale items, used or damaged products unless defective, gift cards, and custom, special-order, or event-specific items, if applicable.

Defective or Damaged Products

If you receive a defective or damaged item, you must notify West Rock within 1 day of purchase. We may offer a repair, replacement, refund, or other accommodation at our discretion after inspection.

Warranties

Products may be covered by manufacturer warranties. West Rock does not provide additional warranties beyond those offered by the manufacturer unless explicitly stated in writing.

13. Promotions, Discounts, Gift Cards, and Credits

  • Promotions, discounts, and offers cannot be combined unless explicitly stated.
  • Promotions, discounts, credits, and offers have no cash value unless required by law.
  • Promotions, discounts, credits, and offers may be modified or discontinued at any time.
  • Gift cards are non-refundable and cannot be redeemed for cash unless required by law.
  • Gift cards do not expire and are not subject to inactivity or service fees, unless permitted by applicable law.
  • Lost or stolen gift cards may not be replaced.
  • Credits may be subject to expiration dates, blackout dates, program restrictions, or other terms stated at issuance.

14. Personal Property and Parking

Guests are responsible for their own belongings. West Rock is not responsible for lost, stolen, damaged, or water-damaged items, including phones, wallets, keys, cameras, watches, jewelry, boards, gear, vehicles, or other property. Guests park at their own risk. West Rock is not responsible for vehicle damage, theft, break-ins, towing, weather damage, public-park activity, or damage caused by other guests or third parties.

15. Health, Fitness, Medical Conditions, and Outdoor Exposure

Participants are responsible for determining whether they are physically able to participate. Guests should not participate if they have medical conditions, injuries, intoxication, fatigue, dehydration, heat-related symptoms, cold exposure, or limitations that make participation unsafe. Guests are responsible for using sunscreen, staying hydrated, dressing appropriately, and deciding whether current weather, water, or physical conditions are appropriate for them. West Rock staff may deny participation when safety concerns exist.

Guests may encounter insects, bees, wasps, wildlife, plants, algae, or other natural conditions that may cause bites, stings, allergic reactions, irritation, or injury.

16. Guest Conduct

Guests may not:

  • Harass, threaten, abuse, or endanger others.
  • Ignore staff instructions or posted rules.
  • Violate applicable public park rules, posted signage, local ordinances, or lawful instructions from public authorities.
  • Cut lines, interfere with riders, or enter restricted areas.
  • Use equipment recklessly or outside its intended purpose.
  • Damage property or misuse facilities.
  • Ride or participate under the influence of alcohol, cannabis, controlled substances, or impairing medication.
  • Bring weapons, illegal substances, or prohibited items onto the property.
  • Use drones, film commercially, or conduct commercial activity without written permission.
  • Swim or enter the water except as part of authorized West Rock activities or as instructed by West Rock staff.
  • Dive, jump, flip, or enter the water from docks, walkways, platforms, railings, structures, shoreline areas, or unauthorized areas unless expressly authorized by West Rock staff.
  • Fish from West Rock docks, floating walkways, launch areas, cable operating areas, or other restricted West Rock-controlled areas unless expressly authorized.
  • Enter docks, launch areas, return areas, floating walkways, cable operating areas, equipment areas, or other restricted zones without authorization.
  • Bring pets into docks, launch areas, floating walkways, cable operating areas, or restricted zones unless expressly permitted by West Rock. Service animals are handled in accordance with applicable law.
  • Engage in behavior that West Rock determines is unsafe, disruptive, inappropriate, or inconsistent with the guest experience.

17. Food, Beverage, Alcohol, and Events

Food, beverage, alcohol, catering, private events, and special event policies may vary by day, permit, vendor, or event type. Guests must comply with all posted rules and applicable law. West Rock may remove guests who are visibly intoxicated, disruptive, unsafe, or violating event policies.

18. Photo, Video, and Media Release

By entering West Rock Wake Park, you acknowledge that photos, videos, livestreams, drone footage, security footage, or promotional content may be captured on-site.

Unless prohibited by law or otherwise agreed in writing, you grant West Rock permission to use your name, image, likeness, voice, riding footage, social media tags, and submitted content for marketing, advertising, social media, website, print, promotional, training, and archival purposes without additional compensation. For minors, parent or legal guardian consent may be required for certain uses.

19. User Content and Social Media

If you tag West Rock, submit photos or videos, leave reviews, comment on social media, or send us content, you grant West Rock a non-exclusive, royalty-free, worldwide right to use, repost, share, edit, display, and promote that content in connection with West Rock's business. You represent that you own or have rights to any content you submit and that it does not violate the rights of others.

20. Website Use, Accounts, and Security

You may use the West Rock website only for lawful purposes. You may not interfere with website security, attempt unauthorized access, scrape or copy content for commercial use, upload malicious code, misrepresent your identity, or use the website to violate laws or third-party rights.

If our website or booking system allows account creation, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

21. Intellectual Property

All website content, logos, names, designs, photos, videos, copy, graphics, icons, brand elements, and other materials are owned by West Rock or licensed to West Rock. You may not copy, modify, distribute, sell, exploit, or create derivative works from West Rock content without written permission.

22. Third-Party Services

West Rock may use third-party platforms for booking, waivers, payments, email, SMS, analytics, advertising, social media, merchandise, events, or other services. Your use of third-party services may be governed by their own terms and privacy policies. These platforms may include VenueSumo, Square POS, MailChimp, Klaviyo, and comparable service providers.

23. Messaging Terms

West Rock offers two text-message programs: (1) transactional messages related to your bookings, purchases, participation, or account, including confirmations, waiver links, weather notices, schedule notices, operational updates, and customer-service messages; and (2) optional marketing messages, including seasonal updates, condition alerts, special offers, event announcements, and promotional messages, which you receive only if you separately opt in.

Message frequency varies. Message and data rates may apply. Consent to marketing messages is not a condition of any purchase. Reply STOP to cancel at any time. Reply HELP for help or contact us at info@westrockwakepark.com or 815-596-9025. Carriers are not liable for delayed or undelivered messages. Our handling of your information is described in our Privacy Policy at westrockwakepark.com/privacy-policy/. You may also revoke SMS consent by contacting us at info@westrockwakepark.com or 815-596-9025. We will honor reasonable opt-out requests as required by law.

24. Disclaimers

The website, facilities, services, activities, programs, content, products, rentals, and materials are provided "as is" and "as available." West Rock does not guarantee that the website will be uninterrupted or error-free, that activities will always be available, that conditions will be ideal, that equipment will fit every participant, that instruction will produce specific results, or that weather or operational disruptions will not occur. West Rock does not provide lifeguard-supervised swimming and does not guarantee that any trick, feature, obstacle, progression, coaching recommendation, or staff suggestion will be safe, risk-free, or appropriate for every participant.

25. Limitation of Liability

To the fullest extent permitted by law, West Rock Wake Park, its owners, employees, contractors, instructors, affiliates, partners, vendors, and representatives are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of use, injury, lost profits, or business interruption, arising from your use of the website, products, services, facilities, equipment, programs, or participation in activities. This limitation includes, without limitation, claims arising from unauthorized swimming or water entry; lack of lifeguard-supervised swimming; use or misuse of floating walkways, docks, platforms, ramps, shoreline access points, stairs, gravel, grass, parking areas, wet surfaces, uneven surfaces, or public areas; cable park systems, moving ropes, handles, carriers, towers, motors, speed changes, start/stop movements, equipment fit, rental equipment, features, obstacles, jumps, rails, ramps, tricks, maneuvers, advanced areas, coaching recommendations, staff suggestions, demonstrations, safety tips, encouragement, participant progression decisions, public lake conditions, water quality conditions, fishing activity, fishermen, fish hooks, lures, fishing line, sharp objects, rocks, sticks, shells, mud, algae, aquatic plants, insects, wildlife, debris, submerged or floating objects, sun, heat, humidity, cold water, wind, rain, changing weather, public park rules, parking areas, vehicle damage, emergency response, medical or ambulance costs, pets, service animals, or conduct by third parties outside West Rock's reasonable control.

For merchandise purchases, West Rock's liability for a product claim is limited to the purchase price of the product, to the fullest extent permitted by law.

26. Indemnification

You agree to defend, indemnify, and hold harmless West Rock Wake Park, its owners, employees, contractors, instructors, affiliates, partners, vendors, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from your violation of these Terms, your violation of park rules, your misuse of equipment, your unsafe conduct, your violation of law, your content submissions, your participation in activities, or claims brought by or related to minors for whom you are responsible.

27. Order Refusal, Service Refusal, Suspension, or Termination

West Rock reserves the right to refuse or cancel any order for reasons including suspected fraud, pricing or listing errors, product unavailability, payment issues, or misuse of promotions. West Rock may also deny access, remove guests, suspend passes, cancel memberships, revoke privileges, or refuse service for unsafe conduct, rule violations, nonpayment, fraud, harassment, intoxication, property damage, or behavior inconsistent with park safety and guest experience.

28. Accessibility Assistance

West Rock is committed to making its website, booking information, waiver materials, policies, and guest communications reasonably accessible. 29. Copyright Complaints / DMCA Notices

If you believe content on a West Rock website, social media channel, or digital property infringes your copyright, please contact us at info@westrockwakepark.com with enough detail for us to identify the content, confirm your ownership or authorization, and respond appropriately. West Rock may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.

30. Order of Terms and Conflicts

If these Terms conflict with a signed waiver, event agreement, membership agreement, private rental agreement, rental equipment agreement, camp terms, purchase-specific terms, or other written agreement, the more specific document controls for that subject matter.

31. Miscellaneous Legal Terms

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. No waiver: West Rock's failure to enforce a provision is not a waiver of its right to do so later. Assignment: West Rock may assign or transfer its rights and obligations in connection with a business transaction, restructuring, or operational change. Entire agreement: These Terms, together with applicable waivers, policies, purchase terms, and written agreements, make up the agreement between you and West Rock for the relevant subject matter. Headings are for convenience only.

32. Governing Law and Venue

These Terms are governed by and interpreted in accordance with the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute arising from these Terms, the website, purchases, services, or West Rock operations shall be handled in the state or federal courts located in Illinois, unless otherwise required by law or agreed in a separate written contract.

33. Changes to These Terms

West Rock may update or modify these Terms at any time. Changes will be effective upon posting in-store or online with a revised "Last Updated" date. Continued use of our website, purchases, bookings, participation, or services after any changes means you accept the updated Terms.
